These Terms of Service govern your use of the LUMIN website (luumin.org) and related enquiry services. The terms are a contract between you (the user or your company) and LUMIN PRIVATE LIMITED (the “Company”, “we”, “our”) of Pakistan. By accessing or using this site to browse products or submit inquiries, you agree to abide by these terms. If you do not agree, you may not use the service.
Scope – Product Inquiries: This site is provided to allow customers and agents to learn about our Himalayan salt products and to submit sample/trial order requests or quotations for custom bulk orders. Nothing on this site constitutes a binding offer or sale. All product information, specifications, availability and prices shown are indicative only and subject to confirmation. In particular, all prices, weights and shipping rates quoted on the site are estimates: the final price will be confirmed in a formal quotation or proforma invoice after review of your requirements. We reserve the right to correct any pricing or description errors. The actual sale of goods will be governed by a separate sales contract or invoice agreed in writing.
Intellectual Property: All content on the Site – including text, images, logos, documents and software – is protected by and are the sole property of LUMIN PRIVATE LIMITED. LUMIN or our licensors own all intellectual property rights in the Site content. You may use the Site content only for your personal, non-commercial purpose of making product inquiries. You agree not to copy, reproduce, transmit, distribute, sell, publish or modify any content of the Site without our prior written permission. You may not remove any copyright or trademark notices on the site. Any feedback or suggestions you provide may be used by Lumin without obligation to you.
Acceptable Use: You agree to use the Site lawfully and appropriately. In particular, you must not: – Use the Site to submit illegal or unauthorized content, or engage in fraudulent or deceptive practices.
– Attempt to hack, probe, or gain unauthorized access to the Site’s systems.
– Interfere with the Site’s operation or with other users’ access to the Site.
– Use any automated means (bots, scrapers, spiders) to access or copy Site content or data.
– Upload or transmit viruses, malware or any harmful code.
– Copy or exploit the Site’s software or design.
– Infringe any third-party intellectual property or proprietary rights.
– Engage in “screen scraping,” framing, deep-linking or similar activities.
Any breach of the above may result in termination of your access. We reserve the right to block or suspend any user who violates these rules. For example, our terms explicitly prohibit copying or modifying Site content or reverse-engineering the Site.
Orders and Payment: You may request samples, trial packs or custom bulk orders for our products. Orders are subject to our acceptance and payment of a proforma invoice or letter of credit (LC) as agreed. Standard payment terms are advance payment (wire transfer or online payment) or confirmed irrevocable LC by a first-class bank in Pakistan. Title and risk of loss pass on delivery (Ex Works our warehouse, unless otherwise agreed). We may require a deposit for custom or large orders. All taxes, duties and customs fees on export/import are the buyer’s responsibility unless otherwise stated.
Warranty Disclaimer: The Site and all content are provided “AS IS” and “AS AVAILABLE” without any warranty of any kind. To the fullest extent permitted by law, Lumin disclaims all warranties – express, implied or statutory – including warranties of merchantability, fitness for a particular purpose, title and non-infringement[11]. We do not guarantee that the Site or any data is error-free, secure or available at all times. Any links to third-party websites are provided for convenience; we are not responsible for their content or privacy practices.
Limitation of Liability: In no event will Lumin (or its partners or suppliers) be liable for any special, incidental, indirect or consequential damages arising out of your use of the Site or products purchased, even if advised of the possibility of such damages. Our aggregate liability in any case is limited to the amount actually paid by you for the product or service in question (only after the product in question has been returned to LUMIN PRIVATE LIMITED and the buyer does not engage in benefitting from that product/service). This limitation applies regardless of theory of liability.
Compliance: You are responsible for compliance with all local export/import regulations and US export controls if applicable. You represent that you are not located in a prohibited country or subject to embargo, and you will not re-export products to forbidden destinations.
Governing Law and Dispute Resolution: These Terms are governed by the laws of Pakistan. Any dispute arising from or relating to these Terms or your use of the Site shall first be attempted to be resolved through good-faith negotiation. If unresolved, the parties agree to submit the dispute to binding arbitration (e.g. under the ICC Rules of Arbitration) in Pakistan, which decision will be final and enforceable. Each party shall bear its own costs of arbitration. Subject to the arbitration clause, any legal action will be in the competent courts of Pakistan, and you consent to that jurisdiction.
Termination: We may terminate or suspend your access to the Site at any time for violation of these Terms, without notice. Upon termination, your right to use the Site ceases immediately.
Severability and Updates: If any provision of these Terms is held invalid, the remainder will continue in effect. We reserve the right to modify these Terms at any time. Significant changes will be notified (e.g. on the Site or by email) before taking effect. Your continued use of the Site after changes constitutes acceptance of the new Terms.
